No credit authorization is active
This preview does not obtain business or personal credit reports. The credit authorization control is disabled. No agreement to the website terms, privacy acknowledgment, or marketing choice authorizes a credit inquiry.
When credit checks take place
Ahava’s clarified workflow includes initial screening and credit criteria before automated pricing, followed by additional conditions in final underwriting. Before any business or personal credit report is requested, the live process must establish the applicable permissible purpose and present any required authorization identifying the requester, report subject, and scope. Later checks must also fall within an applicable permissible purpose and authorization. Browsing, preliminary pricing, or a signed funding agreement does not by itself establish unlimited authority to obtain reports.
Identify the report and its purpose
Before a live credit check, identify the exact entity requesting the report, the person whose report is requested where applicable, the report type, the purpose, and any named funding provider receiving it. Do not describe an inquiry as soft or hard until the actual bureau and provider configuration is confirmed.
Consumer reports require a permissible purpose
An owner’s personal consumer report can be subject to the Fair Credit Reporting Act even in a business funding context. A permissible purpose under FCRA must exist. If relying on the consumer’s written instructions, the instructions must be properly scoped to the actual request. A checkbox cannot cure a missing permissible purpose. Business-only reports and mixed reports require their own applicability assessment.
Authorization scope must be specific
The final authorization must identify the relevant person and requester, report use, scope, duration, and any subsequent review or renewal requests that are actually authorized. Do not use an indefinite authorization for unspecified affiliates or providers. Access must be limited to the authorized purpose.
Separate from other permissions
Credit authorization is separate from electronic-delivery consent, optional marketing, account access, document collection, and any bank debit or ACH authorization. A live flow must preserve the exact disclosure version and evidence of affirmative action and identity verification appropriate to the transaction.
Notices and disputes
If a decision uses a consumer report, evaluate any applicable FCRA adverse-action duties and any separate ECOA/Regulation B duties. Required notices depend on the transaction and decision. The production workflow must support the relevant notices, reporting-agency details, and dispute or report-request rights where applicable. This page is not an adverse-action notice.
Before enabling credit checks
The intended requester is Ahava Capital Group LLC. Confirm its role; providers for both business and personal reports; permissible-purpose basis; owner identity and authorization process; recipients; inquiry type; retention; and applicable notices. Counsel and the reporting provider should approve the final authorization and workflow.
